How many cannabis plants can I legally grow?

Answer: Cultivation of hemp with THC is prohibited in principle

The cultivation of hemp with 1% THC or more is generally prohibited in Switzerland! 1% THC is such a low value that no intoxication can be produced with such plants. Already cuttings can have over 1% THC. Flowers or hashish usually come to at least 5 to over 20 % THC. Nevertheless, anything above 1% THC is considered a prohibited narcotic.

Those who take pictures of their illegal cannabis plants should at least make sure that the pictures are saved without GPS coordinates. Otherwise, finding the plantation or plant is an easy task. In general, it is best not to photograph illegal plants, materials or even consumption at all.

The cultivation of CBD hemp with less than 1% THC, on the other hand, does not fall under the NarcA and is permitted, but must be reported depending on the canton. Numerous producers offer such products on the Swiss market. Private individuals are also allowed to grow such plants, but this may well lead to criminal proceedings: The police may suspect that the plants are illegal. Then this must be clarified. Either with a quick test (which can distinguish low THC from high THC plants) or with an analysis in a laboratory (if you want to know exactly).

Many THC users think they are allowed to legally grow a few plants weed for themselves. This is a mistake. Since the consumption of cannabis containing THC is already punishable, the possession or cultivation of hemp for smoking pot is of course also prohibited. There are no legal hemp plants for smoking pot. Not even a single one.

For the sake of completeness...

There is a rather theoretical exception: Anyone who possesses/purchases/cultivates up to 10 grams of cannabis containing THC for their own consumption is not liable to prosecution. (But beware: the consumption, however, is always prohibited.) So if someone grows an extremely small plant for his own consumption, this can be exempt from punishment. However, the plant must be really very small and should also be under the 10 grams when wet (because if a plant has 20% THC when dried, then it may well have a few percent THC when wet).

...and the hemp seeds?

Also hemp seeds are illegal: As soon as a seeds can grow into a plant with more than 1% THC, it is a “narcotic of the effect type cannabis”, according to the wording in the law.

What exactly is prohibited?

What exactly is prohibited in Switzerland is defined by the BetmVV-EDI, which lists the following substances:

  • “Cannabis: hemp plants or parts thereof that have an average total THC content of at least 1.0 percent and all articles and preparations that have a total THC content of at least 1.0 percent or are made from hemp with a total THC content of at least 1.0 percent.”
  • Cannabis extract, cannabis resin, cannabis oil and cannabis tincture: “see under cannabis”.
  • Cannabis seeds and cannabis cuttings “for cannabis plants with a total THC content of at least 1.0 percent.”
